Hold Harmless
CheckMyFees.com is a service provided at direct cost to you and by accessing this site, you agree that:
1. You are at least 18 years of age, and of legal age to agree to this contract.
2. You understand and agree to the terms of this agreement.
3. While we do try to insure the data on this web site is accurate, the information provided on this site is entered by others on the internet and may have errors that are intentionally or unintentionally input by others that is inaccurate. You agree to hold CheckMyFees.com harmless from any errors on this site.
4. You will only input actual data from home loans you are taking out in your name. You will only input data that is, to the best of your knowledge, accurate and complete. You also understand and agree that any erroneous information you input into this site could be interpreted as sabotage and could be prosecuted.
5. You understand and agree that while CheckMyFees.com does not collect personal information unless you give it, that IP addresses may be captured for data integrity purposes. These IP addresses could be used in the event of prosecution.
6. You understand and agree that the data on this web site is for personal use only, and will not be used for any commercial purpose unless you obtain written permission from CheckMyFees.com.
7. You will not copy, transmit, reverse engineer, or use the information received from CheckMyFees.com for any other purpose than comparing your personal mortgage loan.
8. CheckMyFees.com will not assume any liability for any information on this web site, nor will we insure the accuracy of this data. We do have methods in place to keep the data as accurate as possible, but there is no possible means to verify the information in the format that it is input. You acknowledge this, and agree to assume all liability, without recourse against CheckMyFees.com, and do so of your own free will.
9. Any services agreed upon by you and CheckMyFees.com personnel will be in writing, and will be done
Licensed Mortgage Personnel
Licensed Mortgage Personnel may also access this site and must agree to the following terms:
1. You agree that you are legally able to provide mortgage services, and that you have met all the required state and/or federal requirements to originate mortgages, or that you are licensed to act in the capacity that you are currently performing
2. You will only use this site for comparison of loans that you are currently providing services on.
3. You may input your loan into our database, and may only do so 1 time for each Good Faith Estimate you provide to your customer, and that each Good Faith Estimate you provide to your customer will improve their fees each time.
4. You will not input inaccurate fees, nor will you use the information provided by this site to charge more than initially disclosed on your loan. You also understand and agree that any inaccurate fees input into this site will be an attempt to sabotage the integrity of this site and may be subject to prosecution.
5. Affiliate mortgage companies agree to honor all requirements of the service as spelled out in the Affiliate Company Agreement.
Availability of Service
Your access and use of CheckMyFees.com may be interrupted, from time to time, for any of several reasons, including, without limitation, the malfunction of equipment, periodic updating, maintenance or repair of CheckMyFees.com or other actions that CheckMyFees.com, in its sole discretion, may elect to take. CheckMyFees.com reserves the right to suspend or discontinue the availability of CheckMyFees.com and/or any portion or feature of CheckMyFees.com at any time in its sole discretion and without prior notice.
You understand that all information, data, text, graphics, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not CheckMyFees.com, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. CheckMyFees.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
Under no circumstances will CheckMyFees.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

Upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, libelous, invasive of another's person or business’s privacy, hateful, or racially, ethnically or otherwise objectionable; impersonate any person or entity, including, but not limited to, a CheckMyFees.com official, forum leader, expert, or falsely state or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content originating with the Service; post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; Intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law; provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act; "stalk" or otherwise harass another; and/or collect or store personal data about other users in connection with the prohibited conduct and activities set forth in the paragraphs above.
You acknowledge that CheckMyFees.com may or may not pre-screen Content, but that CheckMyFees.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or remove any Content that is available via the Service.
Without limiting the foregoing, CheckMyFees.com and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. You understand that the Service and software embodied within the Service is the sole property of CheckMyFees.com, and that use of these materials is subject to usage rules set by CheckMyFees.com and/or content providers who provide content to the Service. You may not attempt to reverse engineer the Service, or copy any of the information provided herein. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part unless permission has been granted in writing, is strictly prohibited.
The information, advice, data, software and content viewable on, contained in, or downloadable from, CheckMyFees.com (collectively, the "Content"), including, without limitation, all text, graphics, charts, pictures, photographs, images, line art, icons, are copyrighted by, or otherwise licensed to, CheckMyFees.com or its Content suppliers. CheckMyFees.com also owns a copyright of a collective work in the selection, coordination, arrangement, presentation, display and enhancement of the Content (the "Collective Work"). All software used on CheckMyFees.com (the "Software") is the property of CheckMyFees.com or its software vendors and is protected by United States and international copyright laws. Viewing, reading, printing, downloading or otherwise using the Content and/or the Collective Work does not entitle you to any ownership or intellectual property rights to the Content, the Collective Work or the Software.
You are solely responsible for any damage resulting from your infringement of CheckMyFees.com's or any third party's intellectual property rights regarding the Trademarks, the Content, the Collective Work, the Software and/or any other harm incurred by CheckMyFees.com or its affiliates as a direct or indirect result of your copying, distributing, redistributing, transmitting, publishing or using the same for purposes that are contrary to the terms and conditions of this Agreement.
Your Use of the Content
You may not modify the Content or the Collective Work or utilize them for any commercial purpose or any other public display, performance, sale, or rental, decompile, reverse engineer, or disassemble the Content and the Collective Work, or transfer the Content or the Collective Work to another person or entity.
Except as otherwise permitted under the copyright laws of the United States, no other copying, distribution, redistribution, transmission, publication or use, other than the non-commercial use of the Content and the Collective Work as permitted by this Agreement, is permitted by you without the express prior written permission of CheckMyFees.com, which permission may be withheld in CheckMyFees.com's sole discretion.
You may not use any meta tags or any other "hidden text" utilizing CheckMyFees.com’s name or trademarks without the express written permission of CheckMyFees.com, which permission may be withheld in CheckMyFees.com's sole discretion.
Severability. – If any of the provisions of this chapter or the applicability thereof is held invalid by any court of competent jurisdiction, the remainder of these provisions of this chapter shall not be affected hereby.
